STANLEY CUP® FINAL EXPERIENCE CONTEST

OFFICIAL RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

  1. SPONSOR: The STANLEY CUP® FINAL EXPERIENCE Contest (the “Contest”) is sponsored by BioSteel, 87 Wingold Ave, North York, ON M6B 1P8 (the “Sponsor”) and is administered by Couche-Tard Inc., Mac’s Convenience Stores Inc. and 612 Creative Inc. (collectively the “Administrators”).
  2. ELIGIBILITY: The Contest is open to legal residents of Canada who are eighteen (18) years of age or older at the time of entry, with the exception of employees, officers, directors, agents and representatives of the Sponsor, the Administrators, the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), each of their respective parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Official Rules (the “Rules”). Entrants who do not comply with any of the Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion.
  3. CONTEST DATES AND TIMES: The Contest begins on February 28, 2023 at 12:00:00 am Eastern Time (ET) and ends on May 1, 2023 at 11:59:59 pm ET (the “Contest Period”), after which time the Contest will be closed and no further Entries (as such term is defined below) shall be accepted. The clock used by the Sponsor and the Administrators to compute Entries will be the official clock to determine the date and time of receipt of an Entry.
  4. AGREEMENT TO BE LEGALLY BOUND BY RULES: By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Rules. 
  5. HOW TO ENTER: NO PURCHASE NECESSARY. Standard text messaging and/or Internet access fees may apply (check your carrier plan for your standard text messaging and internet access fees). During the Contest Period: (a) visit a participating Circle K or Couche-Tard store in Canada and purchase a Participating Product (as such term is defined below); (b) locate and scan the Contest QR code or go to https://games.circlek.com/ca/biosteel (the “Contest Website”), and (c) select your province/territory of residence, enter the barcode of a Participating Product and complete all mandatory fields on the entry form (each an “Entry Form”) as directed, which may include your first name, last name, postal code, email address and mobile number with area code. You will also be required to confirm that you have read, understood and accepted the Rules as well as the Sponsor’s and the Administrators’ privacy policies and click on the “Send” button. By successfully transmitting a completed Entry Form as directed during the Contest Period, you will receive one (1) in-store entry in the Contest (each an “In-Store Entry” and collectively, the “In-Store Entries”). 

    Participating Products

    The products listed below (each a “Participating Product” and collectively, the “Participating Products”) are eligible for use on the Entry Form subject to availability and while supplies last. Some sizes or products may not be available at all participating stores.

    NO PURCHASE ENTRY: Purchase is not required and does not enhance a person’s chances of winning. If you wish to obtain a barcode without purchase, please send your request, including the name of the Contest, your first name, last name, mobile number with area code and email address, and include a twenty-five (25)-word minimum hand-written essay about “What your favourite BioSteel product and flavour is and why” on a plain piece of white paper with a stamped envelope to:

    Upon receipt of your eligible submission, one (1) eligible no purchase barcode (the “No Purchase Barcode”) will be emailed to the email address provided in the submission. Maximum of one (1) No Purchase Barcode will be sent per email request. To complete your no purchase entry, visit the Contest Website during the Contest Period, select your province/territory of residence, enter the No Purchase Barcode and complete all mandatory fields on the Entry Form as directed, which may include your first name, last name, postal code, email address and mobile number with area code. You will also be required to confirm that you have read, understood and accepted the Rules as well as the Sponsor’s and the Administrators’ privacy policies and click on the “Send” button. By successfully transmitting a completed Entry Form as directed during the Contest Period, you will receive one (1) no-purchase entry in the Contest (each an “No Purchase Entry” and collectively, the “No Purchase Entries”).

    The In-Store Entries and the No Purchase Entries are each an “Entry” and collectively, the “Entries.” LIMIT: one (1) Entry per twenty-four (24)-hour period per person regardless of method used. No limit of total Entries during the Contest Period as long as a 24-hour window is respected.

    The Sponsor is not responsible for lost, stolen, or destroyed No Purchase Entries or No Purchase Barcodes. The Sponsor reserves the right to limit the number of No Purchase Barcodes sent to seven (7) per week to the same address. All requests for No Purchase Barcodes must be post-marked and received during the Contest Period. The Sponsor assumes no responsibility for lost, stolen, delayed, illegible, damaged, misdirected, late, or otherwise ineligible requests for No Purchase Barcodes, all of which are void.

    The entrant must submit each Entry personally. By entering the Contest, entrants fully and unconditionally agree to be bound by these Rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Contest. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Rules are void. Entrants grant the Sponsor and the Administrators a non-exclusive license to use all Entries for any purpose. No correspondence will be entered into except with selected entrants. Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an Entry.

  6. CONTEST PRIZE: There is a total of ONE (1) prize (approximate retail value outlined in Schedule A) (the “Prize”). ONE (1) winner will receive the Prize listed in Schedule A. The winner assumes any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or use or redemption of the Prize. The Prize must be accepted as awarded and has no cash value. The Prize or any portion thereof cannot be combined with other discounts, promotions or special offers. The Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised Prize is unavailable at time of award. The Prize cannot be sold or transferred to a third party or be exchanged in whole or in part for cash. In the event that the winner is unable to claim the Prize as awarded, no compensation or substitution will be granted by the Sponsor, the Administrators or their subsidiaries and suppliers or by any other party associated with the Prize.


    The Prize consists of the opportunity for the confirmed winner and one (1) guest (subject to Guest Requirements noted below – the “Guest”) to travel to the city hosting the 2023 STANLEY CUP® Final (“Host City”). The Prize includes (i) roundtrip airfare (economy class) for the confirmed winner and his/her Guest to the Host City from a Canadian airport near the confirmed winner’s residence (as determined by the Sponsor in its sole and absolute discretion) in the form of airfare gift card or voucher; (ii) accommodation for the confirmed winner and his/her Guest (double occupancy) for two (2) nights in a hotel or hotels determined by the Sponsor in its sole and absolute discretion in the form of hotel vouchers; (iii) $1,000 CAD spending money for the confirmed winner in the form of two (2) gift cards; and (iv) two (2) general admission tickets to attend the 2023 STANLEY CUP® Final. As between the Sponsor and the Contest winner, arena seating type and location will be determined by the Sponsor in its sole and absolute discretion.

    The Prize has a total approximate maximum retail value of $7,000 CAD although the actual retail value will vary depending on the point of departure (see Schedule A for details). Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) and all other aspects of the Prize are at the sole and absolute discretion of the Sponsor.

    Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at the Sponsor’s option; (iii) all travel related to the Prize must occur on the dates specified by the Sponsor (otherwise the Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner and his/her Guest must: (a) have all necessary documentation to permit travel (including, if required, international travel to the United States of America and re-entry to Canada); and (b) travel on the same itinerary as set by or on behalf of the Sponsor; (v) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner and his/her Guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; the cost and expense of any required COVID-19 testing; transportation for confirmed winner and his/her Guest to and from the Canadian departure airport selected by the Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: confirmed winner and/or his/her Guest may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if the confirmed winner and/or his/her Guest do not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) the Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all travel arrangements relating to the Prize must be made through the Sponsor or its designated agents; and (ix) by accepting the Prize, the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties (as defined below) if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

    Guest Requirements: The confirmed winner’s Guest must: (a) either be eighteen (18) years of age or older or, if a minor, have the express written consent of a parent or legal guardian (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner on the Prize trip; and (b) sign (and have his/her parent/legal guardian if he/she is under the legal age of majority in his/her jurisdiction of residence) and return the Sponsor’s release (by the date indicated on the release form) indicating (among other things) that he/she waives all recourse against the Sponsor and all of the other Released Parties (as defined below) relating to his/her participation in the Prize (including, without limitation, any travel related thereto).

    It is strongly recommended and encouraged that each confirmed winner and his/her Guest obtain sufficient personal travel and medical insurance prior to departure. Flights are subject to availability, blackout periods, government restrictions and regulations, airline, airport or other transportation restrictions and regulations. The Sponsor and other Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of the Prize – including, but not limited to flight(s) and/or the 2023 STANLEY CUP ® Final. Neither a confirmed winner nor his/her Guest nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The Sponsor will not replace any lost or stolen tickets. Changes to flights and/or passenger names are not accepted once bookings have been confirmed.

    Winner and Guest must abide by all venue policies and event ticket terms and conditions including any rules and regulations related to COVID-19. The Sponsor reserves the right to revoke the full or partial Prize from any winner or winner’s Guest who it or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or may bring the Sponsor or the NHL Entities into disrepute. 

  7. ODDS OF WINNING: The odds of winning depend on the total number of eligible Entries received during the Contest Period.

  8. SKILL-TESTING QUESTION: Selected Entrants (as defined below) will be required, as a condition to winning the Prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question to be administered via the Sponsor’s release.

  9. WINNER SELECTION AND CONFIRMATION: Winner will be selected and confirmed as per Schedule A. The Sponsor, or an employee, agent or other representative of the Sponsor, or the Administrators, will conduct a random draw from all eligible Entries received during the Contest Period and select the potential winner (the “Selected Entrant”). The Selected Entrant will be deemed a winner if they meet all of the eligibility criteria set out in these Rules. If the Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a Prize and another entrant will be selected by way of a random draw from the remaining eligible Entries. Before being declared a winner, the Selected Entrant will be required to: (i) correctly answer the Sponsor’s skill-testing question; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity release form (the “Release Form”); and (iii) comply with all other Rules, all in the sole discretion of the Sponsor.

    The Selected Entrant will be notified within five (5) business days of the draw and will be contacted via the email address provided at the time of entry into the Contest, in Sponsor’s sole discretion, and up to two (2) attempts will be made within forty-eight (48) hours following the first notification. If the Selected Entrant does not or cannot accept, the Prize may be forfeited. The Release Form must be signed by the Selected Entrant and his/her Guest and received by the Sponsor as per the timelines detailed in Schedule A. The Sponsor and Administrators are not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response and/or Release Form. If the Selected Entrant cannot be contacted within the allotted time or is unable or unwilling to accept the Prize for any reason, that person forfeits the right to win the Prize; another entrant's name may then be randomly drawn for that Prize and the process will be repeated to contact that new Selected Entrant.

    Disputes regarding identity of entrant: If the identity of a Selected Entrant is disputed, the Entry will be deemed to have been submitted by the individual assigned to the email address or, if applicable for entry, social media handle associated with the entry (the “Authorized Account Holder”). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder associated with the selected entry.

    The Prize will only be awarded to the confirmed winner. If a potential winner of the Prize (a) fails to correctly answer the skill-testing question, (b) fails to properly complete the Release Form and return it within the required time, (c) fails to comply with these Rules (as determined by the Sponsor in its sole discretion), (d) cannot be contacted in accordance with these Rules for any reason and/or (e) cannot accept the Prize for any reason, he/she will then be excluded from the Contest (and must waive all rights to the Prize) and another draw will be held for an entrant to be selected for that Prize.

    The Sponsor assumes no liability after delivering the Prize, and the winner must assume the risk of loss or damage to the Prize after shipping. The Sponsor and Administrators make no representation or warranty of any kind with respect to the appearance, safety or performance of the Prize. The Prize will be delivered to the winner by mail or e-mail, as determined by the Sponsor at its sole discretion within four (4) weeks of receiving the correctly completed Release Forms. The Sponsor is not responsible for contacting or forwarding the Prize to a winner who provides unclear or incomplete information, or for prizes lost, misdirected, delayed or destroyed while in transit.

  10. RELEASE AND INDEMNIFICATION:
    1. Disclaimer of liability – Conduct of the Contest. The Sponsor, the Administrators, the NHL Entities and each of their respective departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, Sponsor and Administrators partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (hereinafter referred to as the “Released Parties”) are not responsible for late, lost, damaged, misdirected, damaged, truncated, illegible or incomplete Entry Forms. Proof of transmission (screenshot, etc.) does not constitute proof of delivery. The Released Parties are not responsible for any problem that may arise, including technical failures related to telephone network lines, online computer systems, servers, Internet service providers, hardware, software, viruses, bugs, personal computer failures and/or software and hardware configurations or the non-reception of an email by the Sponsor or an entrant for any reason, including line congestion on the Internet or on any website or any combination of these factors. The Released Parties are not liable for any damage to a user's system resulting from entering the Contest or downloading the information necessary to enter the Contest.

    2. Disclaimer of liability – Contest or Prize entry. By entering or attempting to enter the Contest, any person releases the Released Parties from any liability for any damage they may suffer as a result of their Entry or attempted Entry in the Contest. By accepting the Prize, a Selected Entrant releases the Released Parties from any liability for any damage they may suffer as a result of the acceptance or use of the Prize.

      The winner must sign the Release Form to: (i) confirm compliance with the Rules; (ii) agree to accept the Prize as awarded; (iii) release, discharge and hold harmless the Released Parties from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of the Prize or any travel related thereto, and the use of the Entry by the Sponsor and Administrators, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or the Prize, liability for physical injury, death, or property damage which the entrant, Guest, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of the Prize and the use of the entry by the Sponsor and Administrators.

      The Sponsor and the Administrators are not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded the Prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected Entries or Release Forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting the Prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of the Prize, including any travel related thereto and the use of the entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
  1. USE OF PERSONAL INFORMATION: By entering the Contest, any entrant selected for the Prize authorizes the Sponsor, the Administrators, and their representatives to use his/her name, photograph, image, voice, place of residence and/or statement relating to the Prize for publicity purposes, without any form of compensation. No communication, commercial, or otherwise, not related to the Contest will be sent to the entrant, unless he or she has otherwise consented. Please refer to the Sponsor’s and the Administrators’ online privacy policies at https://www.circlek.com/privacy-policy and https://biosteel.ca/policies/privacy-policy

  2. OTHER CONDITIONS:

    Subject to the approbation of the Régie des alcools, des courses et des jeux where required, the Sponsor reserves the right to terminate, suspend, or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously-received eligible Entries received during the Contest Period, subject to the approbation of the Régie des alcools, des courses et des jeux where required.

    Law: The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Ottawa, Ontario.

    Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor, the Administrators or the NHL Entities, as applicable. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor, the Administrators, or the NHL Entities, as applicable, is strictly prohibited. The Sponsor’s marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any submissions or materials generated by entrants.


    Entrants residing in QC only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
